1.1 Agent means Butterfly Lake Cottage Rentals (BLCR);
1.2 Owner means the owner of the property offered for rent
1.3 Premises means the vacation property offered for rent;
1.4 Renter means any person for whom a booking of the Premises is accepted
1.5 Client means the applicant named on the Cottage Rental Application
2. Application and contract:
2.1 The acceptance of any application submitted by a prospective Renter shall be at the discretion of BLCR.
2.2 The Renter agrees to abide by the conditions set forth by the Owner and shall be responsible for any and all guests, their behaviour, and their care of the Premises.
3. Rental Fees:
3.1 Payments are made to Butterfly Lake Cottage Rentals
3.2 Bookings shall be confirmed in writing by BLCR upon approval of application and upon receipt of a deposit equal to 30% of the total rental cost
3.3 If an application is approved less than 30 days before the first day of the rental period, the total rental fee must be paid by money order, certified cheque, or credit card. Upon receipt of payment, BLCR will confirm the rental
4. Cancellation:
4.1 Any cancellation made by the client shall be in writing to BLCR.
4.2 If BLCR is able to rebook the cottage for the entire rental period, it shall refund all monies paid less a cancellation fee of $75 per cancelled week or part thereof
4.3 If BLCR succeeds in rebooking the cottage for only a portion of the cancelled time, it shall refund the monies paid relating to the period rebooked, less a cancellation fee of $75 per cancelled week or part thereof.
4.4 If BLCR is unable to re-let the Premises at all, then all monies paid by the Client shall be forfeited
5. Representation:
5.1 The information contained in any text or photo advertising is believed to be accurate. However, minor changes will be made to the Premises from time to time. BLCR gives no warranty as to the condition of the property and accepts no liability for any act or default on the part of the owner
5.2 Audiovisual equipment, boats, motors, appliances, etc. may be supplied by the Owner as an added feature for the Client. While every effort will be made to ensure that such equipment is in good working order, neither BLCR nor the Owner take responsibility for replacing it or refunding the Client for the lack of use of it
6. Number of Occupants
6.1 Clients who have guests at the Premises exceeding the preauthorized number as named on the application form may be subject to immediate eviction without refund or a $100 per night per guest charge
6.2 We have a 'no-party' policy and zero tolerance regarding this issue. We have good neighbours to consider.
6.3 Sub-letting of the cottage is not permitted; rather, where various parties of renters plan to occupy the Premises, rental application forms must be approved for each party.
6.4 Camping, tenting, or the placement of other auxiliary accommodations is not permitted on the Premises without prior written authorization from BLCR.
6.5 Any person regardless of age is counted as a person in the occupancy of a cottage
7. Cleaning, Contents and Supplies
7.1 The client shall leave the Premises and all contents in the same state of repair and condition as at the commencement of the rental.
7.2 The client shall leave the Premises in the same state of cleanliness
7.3 Linens (sheets and pillowcases) and towels (kitchen, washroom and beach) are NOT provided unless specified otherwise
8. Liability
8.1 BLCR will not be liable for any consequential damages, loss or expense in connection with the use of the Premises or the inability to use the Premises for any purpose whatever. BLCR's maximum liability for all damages, losses and causes of action, whether in contract, tort or otherwise shall not in any case exceed in aggregate the contract price for the rental.
8.2 The Client agrees to indemnify and hold BLCR and the Owner harmless against any and all loss, claims, causes of action, demands and/or costs and expenses that may be incurred by the Client in relation to the cottage rental.
Credit Card Guarantee for Damages
I am providing my credit card number as a guarantee. I agree to pay all outstanding long distance phone charges, cleaning or garbage charges, any and all damages caused accidentally by myself and my guests and any penalties as per the Terms and Conditions, caused during the term of my rental. I understand that these costs will be charged to my credit card.
